Welcome to Kazoolo SportsMate. By accessing or using the Kazoolo SportsMate mobile application, website, or related services (collectively, the “Services”), you agree to be bound by these Terms and Conditions and ***Kazoolo SportsMate SMS Program Terms. If you do not agree to these terms, please do not use our Services.

1- Acceptance of Terms

By creating an account, accessing, or using Kazoolo Sports Mate, you acknowledge that you have read, understood, and agree to comply with these Terms and Conditions and our Privacy Policy.

2- Eligibility

You must be at least 13 years old, or the minimum age required by applicable law in your jurisdiction, to use Kazoolo SportsMate. By using the Services, you represent and warrant that you meet these eligibility requirements.

3- User Accounts

Users are responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account. You agree to provide accurate and current information during registration and to update such information as necessary.

4- Acceptable Use You agree not to:

• Use the Services for any unlawful purpose.
• Harass, abuse, or harm other users.
• Upload or distribute malicious software or harmful content.
• Attempt to gain unauthorized access to any part of the Services.
• Interfere with the operation or security of the Services.

5- Sports Activities and Events

Kazoolo SportsMate provides tools to connect users and organize sports activities. Kazoolo SportsMate is not responsible for the conduct, safety, quality, legality, or outcomes of any events, activities, or interactions between users. Participation in sports activities is at your own risk.

6- Intellectual Property

All content, trademarks, logos, software, and materials provided through Kazoolo SportsMate are owned by or licensed to Kazoolo SportsMate and are protected by applicable intellectual property laws. Users may not copy, modify, distribute, or exploit any content without prior written permission.

7- Account Suspension and Termination

Kazoolo SportsMate reserves the right to suspend or terminate accounts that violate these Terms and Conditions or engage in conduct that may harm the platform, its users, or third parties.

8- Disclaimer of Warranties

The Services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. Kazoolo SportsMate does not guarantee uninterrupted, secure, or error-free operation of the Services.

9- Limitation of Liability

To the fullest extent permitted by law, Kazoolo SportsMate shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.

10- Changes to Terms

Kazoolo SportsMate may update these Terms and Conditions from time to time. Continued use of the Services after changes become effective constitutes acceptance of the revised terms.

***Prohibited Pornographic and Sexually Explicit Content - Pornography and Sexually Explicit Material***

To maintain a safe, respectful, and lawful environment, users are strictly prohibited from uploading, posting, sharing, transmitting, requesting, promoting, selling, or distributing any pornographic, sexually explicit, or obscene content through the App.

Prohibited content includes, but is not limited to:

• Pornographic images, videos, or live streams.
• Sexually explicit photographs or recordings.
• Nudity intended for sexual gratification.
• Content depicting or promoting sexual acts or fetishes.
• Content that advertises, solicits, or facilitates sexual services.
• Links to websites or services containing pornographic or sexually explicit material.
• AI-generated or digitally altered sexually explicit images or videos.
• Any content involving the sexual exploitation, abuse, or endangerment of any person.

The App has a zero-tolerance policy for child sexual abuse material (CSAM), child exploitation, or any content involving minors in a sexual context. Such content will be removed immediately and may be reported to the appropriate law enforcement authorities.

We reserve the right, at our sole discretion, to review, remove, restrict access to, or permanently delete any content that violates this policy without prior notice.

Users who violate this policy may be subject to one or more of the following actions:

• Immediate removal of the prohibited content.
• Temporary suspension of account privileges.
• Permanent termination of the user account.
• Restriction from creating future accounts.
• Reporting to law enforcement or other governmental authorities where required or permitted by applicable law.

By using the App, you acknowledge and agree that you are solely responsible for all content you upload, post, or share and that any violation of this policy may result in the actions described above.

Nothing in this policy limits our ability to take any additional action we deem necessary to protect our users, comply with applicable laws, or preserve the integrity and security of the App.

**Misc. Prohibited Content Policy**

To provide a safe, respectful, and lawful platform, users may not upload, post, transmit, share, promote, distribute, or otherwise make available any content that violates these Terms or applicable law.

Prohibited content includes, but is not limited to:

1. Pornographic and Sexually Explicit Content

• Pornographic or sexually explicit images, videos, audio, or text.
• Nudity intended for sexual gratification.
• Sexual acts or fetish content.
• AI-generated sexually explicit content.
• Content promoting or facilitating prostitution, escort services, or sexual exploitation.
• Links to pornographic or adult websites.

2. Child Safety

The App has a zero-tolerance policy for child sexual abuse material (CSAM), child exploitation, grooming, or any sexual content involving minors. Any such content will be removed immediately, accounts will be permanently terminated, and information may be reported to law enforcement and appropriate authorities.

3. Harassment and Bullying

Users may not:

• Threaten or intimidate others.
• Harass, stalk, or bully individuals.
• Encourage self-harm or suicide.
• Publish private or confidential information without authorization.
• Engage in abusive or targeted harassment.

4. Hate Speech and Discrimination

Content that promotes, encourages, or incites hatred, discrimination, or violence against individuals or groups based on protected characteristics, including race, ethnicity, national origin, religion, disability, sex, gender, gender identity, sexual orientation, or other protected status, is prohibited.

5. Violence and Dangerous Content

Users may not post content that:

• Encourages or glorifies violence.
• Promotes terrorism or extremist organizations.
• Incites criminal activity.
• Encourages dangerous acts likely to cause serious injury.

6. Illegal Activities

The App may not be used to:

• Buy, sell, or distribute illegal goods or services.
• Commit fraud or scams.
• Promote money laundering or other criminal conduct.
• Violate applicable local, state, national, or international laws.

7. Impersonation and Deceptive Conduct

Users may not:

• Impersonate another person or organization.
• Misrepresent their identity or affiliation.
• Create fake accounts to deceive others.
• Mislead users regarding the source or authenticity of content.

8. Spam and Unauthorized Commercial Activity

Users may not:

• Send unsolicited or repetitive messages.
• Distribute spam or phishing content.
• Use automated bots without authorization.
• Advertise or solicit business in unauthorized areas of the App.

9. Intellectual Property

Users may not upload or distribute content that infringes upon another person’s copyright, trademark, patent, trade secret, or other intellectual property rights. Users are responsible for ensuring they have the necessary rights and permissions for all content they post.

10. Malware and Security

Users may not upload or distribute viruses, malware, ransomware, malicious code, or attempt to interfere with the security, functionality, or availability of the App or its services.

Enforcement

We reserve the right, at our sole discretion, to investigate any suspected violation of these Terms and to remove content or take appropriate action, including:

• Removing prohibited content.
• Suspending or permanently terminating user accounts.
• Restricting access to the App.
• Reporting illegal activity to law enforcement or regulatory authorities where appropriate.
• Taking any other action necessary to protect our users, the App, and our legal rights.

Users are solely responsible for the content they create, upload, or share. By using the App, you agree to comply with these Terms and acknowledge that violations may result in immediate enforcement actions without prior notice.

*Kazoolo SportsMate SMS Program Terms*

Program Description: Kazoolo SportsMate sends One-Time Passcode (OTP) verification messages for secure login, account actions, and occasional match alerts or sports community notifications to help users find local pickup games and teammates.You can cancel the SMS service at any time. Just text "STOP" to the short code or long code. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

1. If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at support@kazoolo.com.
2. Carriers are not liable for delayed or undelivered messages.
3. As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive messages on a recurring or as-needed basis (message frequency varies). If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
